Tire Wear Lawsuit

A&Q about 350Z
Q:

since they filed it as a 350ZX problem, none of us will get squat on a technicality.
it will be thrown out, because the proper model is the 350Z. in essence, the court will FIND that the 350ZX has a tire problem, and only 350ZX owners will get a settlement. i.e. just the lawyers.
those of us with 350Z's will be out of luck.

uh, there is no such car as a 350zx, so there's no possibility for confusing the reference with some other car.

What's a unidirectional *RIM*?
You do know what this means don't you? The word may be funny, but it is correct.

A:

The tires are unidirectional, not the rims.

My Bad, I am not familiar with the 350Z, I thought they were the same as the Z32, wheels are directional too.

sorry, it sounded like some of the posts in this thread were serious about a slight misuse of terminology hurting the case.
A:

frivolous lawsuits hopefully get thrown out of court. $74000 ? thats more than double the cost of the whole car, sounds like another greedy ambulance chaser to me. fookin bastidges.

I'll bet anyone on this board $5.00 that Nissan offers to buy back our cars, or offers us 100,000 mile tire warranties+cash if we decide to keep the cars.
Mark this thread, because I will. This is not a small deal for Nissan. This is a major, major event and by no means is a buyback + damages unrealistic if it can be proved that Nissan knowingly sold us 350z's with alignment flaws.

The lawyer they listed is the same guy that won the Firestone/Ford lawsuit. Call it frivolous if you want but if I were Nissan, I'd be making a contingency plan. At this time and with all the problems I have had with the car, a buyback would be great.

Here's the guys website posted on My350Z.com. Read the top of the page. His goal in life is to make big companies pay. Everyone needs a goal I guess.

I just e-mailed him. I'll let you know the response if any.

I was involved in a multi-million dollar lawsuit against Sears back in about '92 or so. I got $10.
A:

you had to see this coming folks
A:

paypal just got one too.
i got a notice yesterday. in it, "counsel" will be awarded $3.4million ++ Fees of a proposed $9M settlement. if you want your check mailed to you, it will cost $1 as a processing fee (ayup), otherwise you can have the amount credited directly to a paypal account.
when was the last time it actually cost $1 for a computer to spend 1.5 seconds spitting out a check, having the automatic folder fold it, the stuffer stuff it, and the stamper stamp it? freakin ripoff i say.
can't wait to get my free can of soda from paypal for abusing it's subscribers.

From here on out Nissan will do squat about the problem because any and all actions from this point on to actually solve the problem will be an effective admission of guilt.
Don't be surprised if the next time you call NNA about the problem you get the old standard "It's the first I've heard of tire wear problems!" response.
Someone once said "Trial lawyers are just thieves too lazy to steal."
A:

Nissan already admitted 3 times in TSB's and then pulled the trigger with the tire warranty. It is what it is.
A:

If I Nissan gives me free tires for life.... I'm keeping it for life!
A:

mazda bought back rx-8s for being overrated. the feathering thing seems like a bigger problem than overrating hp to me, but i have no idea how they compare legally.
A:

Wow, I'm impressed. Many thanks for all of the info.
You guys have reaffirmed that this board is still useful for something other than an outlet for adolescent aggression.
Thanks.

As noble as the attorneys try to make themselves sound, class action lawsuits do NOTHING to help those who have been "wronged" by whomever the attorneys have decided is a convenient target. If this Texas knight in shining armor was doing this for the "injured" parties, his attorney's fees would probably come to around $200,000 for actual time at inflated attorney prices. What he'll demand in the settlement is tens of millions, hoping Nissan will settle for millions.
It's all about the settlement. These leperous vipers do not want these things to go to trial.
What will YOU get as the "wronged" owner? A pittance.
So hug your friendly class action attorney, Labshark. He truly has your best interest at heart.
A:

regardless of how much z owners will directly benefit from the lawsuit, it will penalize nissan and it will bring more publicity to the issue hopefully pressuring nissan to fix the problem.

72n03Zs,
Your points are not supported by any facts what so ever.
The facts of the matter happen to be, that Nissan has had 2 years to solve this problem. They have not.
This is a saftey issue, for all of our cars.
Several owners have spent several thousand dollars on tires, before Nissan decided to extend the alignment warranty.
It is a known fact that the alignment "fix" does not solve this issue.
It is a known fact that the tire rotation "fix" does not solve this issue.
It is known that suspension and wheel/tire upgrades have resulted in extremely limited success.
It is a known fact that Nissan has refused to reimburse owners who have had to purchase their own tires, after 20,000 miles.
So I ask you, what would the next course of action, in your world be? Do you want to continue writing letters, as have thousands of other owners?
Do you want to continue posting, with the hopes that Nisan out of the goodness of their heart is going to spend the tens of millions of dollars required to fix this issue? I have been through 6 tires in 8,500 miles. 7 alignments, and my tires are still in need of replacement.
There have been countless avenues explored, and attempted in the two years! 24 months! 700+ days this has been going on. So again, what would your next course of action be?

After wearing out two sets of front tires (after having it aligned and tires replaced at the dealer where I got my car!) I've had my Z aligned and tires replaced by a competent dealer service department that seems to care, and have had ZERO problems since (around 8k miles ago)... nothing but only the slightest visible hint of feathering and no noise at all. This just proves that the problem CAN be cured using Nissan's TSB, but it seems, as Nissan has said, that most of the problem lies with lax and incompetent dealerships.
Further, I find it funny how people call this a safety issue... it isn't. The only reason it would result in an unsafe condition is if you do not look at your tires regulalry and fail to replace them before they wear out.
I still fault Nissan however.... they should be taking a more proactive role in making their dealers handle this problem properly. Nissan has the fix, they just don't seem to care if their dealers can and will do it! Sadly, most car manufacturers don't do any better than Nissan... that's why we have to put up with bait-and-switch sales tactics from sales personnel that know as much about cars as they do nuclear fission and service departments that make Jiffy Lube look professional.
