What to do?

Q:

I just had my car at the dealer getting the window motor replaced and I had them check on this annoying rattle that came from the left rear of the car everytime I hit a bump. The dealer said that it looks like I was in an accident(which I mentioned in an earlier post). They noticed new exhaust and cracked foam behind the bumper. It wasnt until further inspection that they noticed I had a bent rear strut which is what was causing the rattle because all of the fluid had slowly leaked out.
What can I do here? Can the Nissan dealer I bought it from be liable for the repair on this? I dont think I should have to pay for this.

Did you buy the car new? If so you have a case. If you can find the original owner, if bought used, you could have a case against the dealer.

Why are you asking the same questions all over again ? This is an " AS IS " used car sale. Even if the dealer knows about ( non-structural ) damage repairs made to this vehicle he isn't obligated to disclose that info to the buyer. IMO he wouldn't have taken the car in if it had any known structural damage. On trade-ins most dealers only require the owner to sign a statement that there has been no structural (i.e. frame ) damage to the car. IMO YOU ARE STUCK. Pray that CARFAX doesn't find out. At least that will keep open the option of dumping the car on someone else at some point in the future. Maybe if you raise enough stink with the dealer he will offer some partial financial assistance in making these additional repairs.

The dealer wanted $290 to fix. I am having Les Schwab do it for $190. I got a decent deal on the car only because I traded in two cars which I owed alot on and they paid them off. I just hope this is it. I dont want to keep running into other problems. The mechanics at the dealer said that is all they could find but I will be checking it some more after work today.

To put your mind at ease about the condition of your car I recommend that you do a side-by-side comparison with another 2003 Z. There must be a 2003 Z owner on one of the forums that you frequent that lives in your area that would do you this favor. Inspect and compare the visible rearend components and body panels, including fit, ID markings, check the undercoating, check for paint overspray, etc. If your car was in a rearend accident there will be other less noticeable telltale signs of repair that a side-by-side comparison will reveal. If you are in Orange County SO CA you can use mine.

Just so you know. Not all states have the same new/used accident disclosure laws. In Okla. all "known" damage over $500 has to be reported to a potential buyer up front.

There are always ways around this. The dealer can just say "we didn't know" you can find out who the dealer bought it from and ask them if they told the dealer it was wrecked. If the dealer is taking two cars to the body shop and one is $1500 and the other is $600 they can say fix that one for $400 and we'll give you $1700 to fix the other one.
In other words it's hard to prove but if the dealer that sold diggler30 the Z knew it had been wrecked they should have told him. But sometimes that's not good business practice.
