The dealer can get rebuilt engines from time to time. That's the least I'd settle for. Unless Nissan will use the factory warranty to cover any future engine problems. Which they won't.
The insurance Rep. is paid to sell you a settlement. Like Tommy posted. Don't cash the check. That is a legal acceptance of their offer.
See if you can do some foot work and talk the dealership down on their price and talk the insurance up on there price. If you can get the dealer down $2k and the insurance up $2k then you get your new engine.
Oh yea. BTW. Don't be a dumbass and drive your 350Z thru water again. Probably learned your leason though didn't ya.

It's crap bags like you that cause State farm to Jack up my rates even though I've never been in an accident. Sure your own rates will go up too.
But you never thought that hey it's only water right? Yea it should be your damn fault... Your damn problem. You make me want to find a different Insurance co. Loser.

Well, thanks Wilson for your helpful insight. But the fact is, it was 11:30 at night as I had said and no street lights and down pouring, hence the flooding. by the time I noticed water I was already in the middle of it. So technically it was not my fault, **** happens. but again, thanks for bein a prick.
But honestly, thanks to the rest of you for being supportive. Its been a stressful last couple weeks dealin with everything. They now found a used engine from a 350z that was totaled in Colorado that has only 2,000 miles on it...might end up being a better deal then what I had, except I don't know what its been through in its first couple thousand miles. Except that it was a leased car, started in March 2003 and totaled a couple months ago.
Hopefully I'll be back on the dry roads soon.

i agree with an eye for an eye, a used engine for a used engine. the likelyhood that it will be defective is low. to others points, a remanufactured engine will probably be actually better - any component that might have been failing is fixed, and certified.
you don't get a brand new warranty either. at the risk of being labeled a prick: i'm a state farm customer. everything i've read about this incident wreaks of bad judgement.

response: this recommends a very cautious approach. question: has the street flooded before? is this a usual occurrence during a downpour? also, is it reasonable to think that there could be street flooding during heavy downpours in general (i think it's reasonable). since it was dark, doesn't that mean extra caution too? a similar phrase could be: it was completely dark and i couldn't see but i drove forward anyway knowing the risks.

response: i'm not convinced. the Z is a pretty low car, admittedly, but you know instantly when you're heading into water as it would begin plowing it. technically not your fault? wrong. since you were not struck by someone else, the decision to proceed was indeed yours alone.
i hate it when i do stupid things. i really do. and i do a lot of them. but, i pay the price... it's only cash and some pride usually. what it is not is a punishment for all others who are part of the "class," in this case customers of State Farm.
