There is a 3 year warranty. Once you receive your new top their is a new 12 month or 12,000 miles warranty on your 2nd top.
BTW waiting a year for a new top is pure
Other guys have had several new tops already. I'm in a process right now about what part # is the new "so-called" replacement. I have a '04.5 and I have been following this top issue for over two years...when I purchased my Z I felt that the top problem was taken care of....even '05's are now reporting top problems. I picked up my car last week and after testing & testing...the top indicator light on the dash stays on even after being closed in the tonneau. I'll be bringing it in Tues or Wed depends on the weather here.
My dealer has been great. I get a free loaner car because my Z is still under warranty. I had the oil change while the car was there and they did not charge me because they felt that the car was left longer than expected.
My SB ZR still feels like HEAVEN....what a wild ride!

the lexus sc430 looks pretty hot with its roof set up, in the long term rag tops are hard to maintain, and in the short term dealing with dealerships sux.

Trust me.. hard tops cost WAY more to maintain than any rag top. There are benz owners with 90k+$ cars that don't use their hardtop very often because they are afraid of it breaking, and these guys have cash.
That being said, it is certainly not uncommon for ragtops to have minor issues, but these are what I'd consider major ones. The s2000 has almost no issues, but it's a specialty, fairly low production car with a very high build quality and simple rag top structure. All s2k's are rag top so the R&D behind them had to work.
BMW z3 tops are pretty reliable, but I've only had experience with a forum and a 2001 model for about a year. Overall the car was junk, but the top didn't cause any problems, surprisingly.

Once they replaced the stop it has a new warrantee. Call the Attorney General's office in your state, make a claim with the better business bureau....and then make a paper mache lemon, put it on top of your car, and take white shoe polish and write that nissan doesn't honor it's work on your back window... and park the car in front of the dealership.
OR, go buy an extended warrantee... don't let you tell you it costs 2200-2400 either... their cost is $1000. The warrantee is bumper to bumper for another 3 yrs... it's cheaper than what you're gonna have to pay
