So today, I'm driving to my girlfriends -- speed limit goes from 55 to 45, so I slow down by tapping my brakes... so the cop behind me pulls me over -- writes me a ticket for following too close ... now, naturally when the speed limit goes down that does place you closer to the vehicle in front of you. So he pulls me over... and here I am looking at the ticket.. and it's dated incorrectly..
01 18 2006 ... today is the 17th....
I remember something about not having to pay a ticket if there is an indescrepency on it.... anyone know the rest of this?

How can we the people trust his judgement if he doesn't know what day it is? How does he know how close you were? Check the defnition of "too close". Did he measure? Better do some research. Ask an attorney or several. You can usually get some information as they tell you what they would do to earn your cash.

if i were you i would get to the courthouse quick and show that since it is dated incorrectly, you wait all they have to say is they did it on the 18th

The only time I have heard of a following to close ticket is:
1. Accident
2. Additional ticket to aggressive driving
My question would be how did he know you were following to close. If you were on the persons bumper then he probably had a valid reason to pull you over. If there was sufficent room to stop if the person in front of you slammed on his/her brakes then I don't know what the cops problem was.
As for the date thing, it's hard to get a ticket dismissed just for the date being wrong. I would go in front of a judge if you feel the ticket is BS.

no idea since like stated before the "following too closely" is usually after an accident that proves that you were actually too close to stop. around here, 1 car lengh (or less) is the usual in rush hour traffic.
so how close were you?

I got a "Following Too Close" ticket on Memorial Day Evening around 2AM on I10 HOV Lane driving behind an Out of Service Foothill Transit Bus with malfunctioning "coast-brake" lights. The lights on the back of the bus are supposed to flash yellow when the drive takes thier foot off the gas.
He was doing 45 in a 65, and was very erratic in speed. I closed distance to try and get around him at the next "entry exit" and as I got closer, he must have lifted totally and downshifted (heard it)---man I sucked RIGHT onto his butt! Like 3 feet behind him doing 35mph in the HOV lane (below the minimum posted legal speed, BTW) and traffic to the right of me doing 80+mph!!! As soon as an opening presented itself, I pulled to the right to pass him and try to get around him so I could take the HOV Spur straight into downtown LA.
Newbie CHP punk officer pulls me over because I was "Driving in the Carpool Lane Solo"---nevermind I was in a Van with HUGE "CNG VEHICLE" Advertising all over it!
He was embarrased to have pulled me over on a B.S. beef, so he ended up citing me for "following too closely".
I decided at that moment the job I had was not worth the aggravation I was experiencing. It exposed me to night shift cops, who are UNIVERSALLY the new guys without enough seniority, and have no real world skills or judgement when dealing with the public.
The CHP WILL cite you for FTC. Usually it has to be pretty blatant. I just wanted to get around the guy, and didn't think jumping out of the HOV lane across double double yellow lines was too kosher.
People who drive in the left lane below the posted speed limit, and below the minimum speed posted, including the HOV lane below the speed limit when the flow of traffic is 80+, should simply be hauled out and shot.
I could not safely get out behind him, no matter what I tried, and when the opportunity finally did present itself, the idiot (on a straight road with no reason whatsoever to brake of lift throttle) slowed down from 55 to below 35 by downshifting and lifting throttle (you could hear it)...
But I got the ticket. I quit that job, and haven't had a run in with dayshift CHP or any other cops since. it really DOES matter when and where you are driving! Low man on the totem pole get the night shift, and they are usually low seniority, young, inexperienced, and want to make some sort of name for themselves, and are out to change the world through traffic enforcement (rolls eyes)....

just wondering if it's part of the crackdown on "road rage" in the state? seem to remember some new laws that take all kinds of actions now as "agressive".

The rule of thumb is to maintain one car length for every 10 mph of vehicle speed. How much time went by from the moment you passed the “45 mph” sign to the moment that the cop decided to stop you? You might have been too slow in slowing down and the cop evidently thought that you were tailgating. The cop can see how close you are to the vehicle in front of you by looking through your rear window and windshield. Tailgaters know who they are and it doesn’t sound like you were tailgating. In your case, you might have been too slow in slowing down.

..I got tailgated by a cop who irritated me enough to speed up until he THEN pulled me over (that sucks!) ...Pretty tricky too!

naw, NEVER speed up if you're tailgated. in fact, that's a gag in the latest "gone in 60 seconds" where a clueless student driver fails the written test at the dmv.

I'd contest that, the ticket is made out for a day that has never existed. If you did something on a day that never existed, did you really do it at all???

If you know exactly how to present it, an error on the ticket can get the ticket dismissed in most cases. Unfortunately, you do not know how to do it.
You can either get professional help or hope the judge is nice.
Rarely can you simply say 'he spelled my name wrong' or 'it's the wrong date' because what does that mean? You think the judge cares, or the cop? You still preformed the infraction, it's not like his radar was miscalculated or something.
It means nothing unless you know how to use it, or your judge is more friendly than any i've known in Houston [or austin].

Just pay it. 1.5 car lengths is far to close. I don't know how much it's for but paying for an attorny, court, and having to deal with the aggravation will cost more than the ticket.

Reading the ticket it says
"in the court designated below the undersigned certifies that he/she has just and reasonable grounds to believe and does believe that on tues 01/18/2006 11:21am chad johnson etc etc did unlawfully commit the follow offense"
Now how can I commit an offense on a day that doesn't exist...
Well I'll talk to that attorney tomorrow -- depending on what he says, decided what I'll do ...

It means he has failed to meet the identity requirement, which kills the ticket. That is what it means.
The date might be less important, but I'd definitely try it.
