I'm going to try to make this as short and sweet as possible.
Last night when I arrived at my girlfriend's I realized there was a sizeable dent behind the rear wheel well on the passenger side. I washed the car 4 days before [would have noticed dent] and didn't drive the car due to the weather until that occasion. This is where it gets a little fishy. This is how and where I always park.
The lexus is the grey vehicle on the left. The black marks are where the car stuck out before because I move it outwards to wash it better. The purple car is my accord. The silver RSX is my roomate's that used to park between my accord and lexus so he would not fear door dings. That turns out to be a little ironic.
Here is where the hit occured, good and bad side to compare.

Unless you have witnesses, it's your baby & would be a chargable claim if filed with your insurance company. Talk to your agent about a "hypothetical situation" & see if it is would affect your rates. Get a repair estimate from a body shop as well. Insurance companies get discounts from the repair shops so negotiate for it if you decide to fix it.

He is the only one that parks next to me and it's on the passenger side. Again, I didn't move the car between when I washed it and noticed there was a dent except to goto my girls in which I would have known if I'd been hit [it was very late and no cars out anyhow].
Is it possible his car even could have done this?
When the lot is more full you have to back up several times to park and it does get tight. I was planning on selling this car before xmas but no one buys these cars with dents. My body guy isn't even going to be avail. for 3 more weeks. Any estimates on how much it'll cost to fix? Thanks guys.
BTW, when I approched him [we have good relations] he said he didn't hit it and someone else probably parked there. The problem is, if you didn't notice from the 1st pic, is that my window looks right at it. I look through it all the time because of where my computer is and no one else did park next to me that I know of, but ofcourse it is possible [very unlikely, we are in a 'cubby' and no one else parks here].

As mentioned, where we park is usually not crowded at all. I usually take up extra spots as they are all 'small car spots only' which you may be able to see on the curb in some pics. My lexus literally has the left/right tires within a couple inches of the white lines when parked correctly.

The ONLY vehicle there LEGALLY AND PROPERLY PARKED is the darker Jeepthing in upper left corner.
Illegally parked vehicles have a hared time justifying damage claims against someone who tried to park legallw within the lines and inadvertently bumps someone.
YOu wer e negligent in parking your vehicle, and they will use that as an excuse to mitigate any responsibility.

lol. Tony D you are overanalyzing it, or at least for my needs. I'm not trying to win a case in court, I'm going to have to pay out of pocket regardless at this point. The thing is, based on the dent's proportions and location, do you think it's feasible the RSX caused it? At least if someone gave reasonable evidence it was not, tensions could be relieved here.
And as for the 'retarded youth', people of all ages live here. This part of the complex is all 'small cars only' spots my lexus literally barely fits in the lines. If two were correctly parked side by side the doors would not open. There are no normal sized spots close by, and since few park in this little corner of the parking lot, it isn't an issue. But I understand your point, yes, the cars are not parked perfect.

You live in a place where the parking structure ENCOURAGES these mishaps.
Sue the building owner for the parking lot design and make HIM pay for your dent, as well as restriping your lines.
This is exactly along the lines of everything else I have been saying here recently. Why does someone ALWAYS HAVE TO BLAME SOMEONE?

If this was a personal vehicle and not to be resold it wouldn't be much of an issue. It's more stressful when you were intending to sell this car to get money for the holidays and instead the little bit you do have left is going into the car. Or, it will be sitting that much longer. You are right Tony D, I'm going to have to let it go sooner or later but to me it may be a bigger deal than to most.
And it IS someone elses fault. It's DIShonesty or carelessnes at blame. If I had hit someone's car, I'd pay to fix it. Not knowing whether it was an accident or not is frustrating but pointless to worry about.

A parking lot is a designated parking area. You are required to park according to the lines. If you are across the lines, you are illegally parked, same as if you are more than X inches from the curb, or in a place with yellow stripes across it with "do not park" signs out there.
The curb also designates "small car parking only" which gives credence to a specific vehicle parking there, and a Lexus may not qualify.
California delineates exactly what kind of vehicle can park in a "compact car only" parking spot. You put an F250SD in there with an extended bed, and crawl out the cab back sliding window to egress, and find a big dent in your tailgate when you return, the cop is likely to tell you that you were parked illegally, in an area not designated for vehicles of that size, and that you're lucky he doesn't cite you for it. And when you press for a report, the nice cop marks the "illegally parked" box on the form, and it gets annotated in your statement from them when you submit it to your insurance company.
Parking across the lines is illegal parking.

By your pictures it clearly shows there is enough room for another car to get between your Lexus and Accord. So if your roomy says he didn't do it and you can't find any damage on his Right Front. Maybe it was someone else.

I don't mean to be disrespectful, but you don't know as much about what you are talking about as I do. I didn't get this car for free. Selling a higher end car with a dent will cause huge profit margin losses, trust me I've been doing this for a while. Let's say I bought the car for 4500 and spent many hours for a few days, as well as personal time checking the car out to get it, to find this 'deal'. Let's say is worth 5750 on the open market if I do it right. With that dent, I probably couldn't sell for any profit. All that time and effort is wasted, not to mention taxes down the drain. Now I have to donate the time and money to get it fixed, and I won't be able to sell it for extra weeks. This isn't going to cost me just 2 or 3 hundred bucks, it's going to cost me 6 grand+ and no/less money for xmas gifts. But that's how the game works.. especially if I fail to park correctly...

My opinion:
There's PLENTY of room between your two cars for the RSX to manuver in and out easily, even with the other cars parked on the other side.. RSX are small, short, and easy to drive.
Both your cars are parked rear end in first. Picture yourself in his RSX and how you steer the wheel. If the RSX parks front end in first, then check his front right bumper. If the RSX parks rear end in first, then check is left rear bumper. Regardless, the dent is farther towards the end/rear of your Lexus. Your dent and rear bumper are farther into the curb/grass. His RSX is pretty low and his front bumper/spoiler is scratching the curb. I just don't think it was the RSX.
Another car (maybe a longer car) may try to squeeze inbetween your Lexus and Accord. Your roommate came home and saw his regular spot taken and took another spot. Or someone could have kick it, bang it with something, may not even be another car. Just speculating.
Let it go. **** happens. When my previous car was keyed, I automatically put the blame on the owner of the car that has the assigned parking spot next to mine. I don't know who really did it, my mind just went wild with speculation because I was pissed off.
On a different note, I dislike people who take two parking spots. I need some of those stickers that says, "I park like an idiot," so I can post them on every one of those cars' windshield (except for that Jeep in the corner).

There are massive areas to the left of that picture where most people park. This area is just for the few people willing to park in a corner and walk a little farther to their places so their cars are left alone. This is about as crowded as the lot gets, so STFU about the parking already, I GET IT.

I think I see what you are saying, but it isn't coming out right. There is no statute or standard that says it's OK to damage an improperly parked vehicle. Agreed that you would "look bad" when you tried to argue it, but people who do not follow the rules of the road have the same protections affording everyone else. The person who hit the parked car is definitely liable, regardless of how the other car was parked.

The bottom line is that no matter how intelligent you are - YOU just learned a HUGH lesson in the value of FULL cverage insurance. if this car was so valuable to you for resale WHY didnt YOU protect YOUR investment with the PROPER insurance. I dont mean to be harsh but man you made a bad business decision when you decided how much and what kind of coverage. As for HIGH END car --sorry but that term and liability insurance only dont work. your room mate said he didnt do it so he didnt. i mean you trust this person with all your household but not his word. thats pretty low and if you have doubts than maybe you should reevaluate your priorities like is your roommate a freind or are you just trying to make a profit on him too. give it some thought. and sorry your car got hit and your stuck with the bill but it happens all the time to people who cant even afford a car like . good luck.

Too much steam about nothing. If your relations with your roommate are fine, and you wish that to continue, let it be. Good roommates don't hang on trees.
The damage is not a "hit". Another owner, or maybe you or me, may sometimes encounter another vehicle while parking or maneuvering, make gentle contact, push some sheet metal or urethane out of line an inch or two, and not even feel or hear it. A "hit" is a crunch, a bang, or a scaping sound. There appears to be no paint damage here, or very minimal, and the panel will probably pull back into line with some effort.
I don't see any major effects when you sell the vehicle. Have a wonderful Christmas!

I like how everything becomes an arguement rather than answering the questions I asked. But I knew that beforehand.
zxtoy. You don't know my circumstances, hence why I didn't ask people if I thought I should have had full coverage or not. I am a full time student paying tuition, rent, cell phone bills, gas, insurance, food, the works. I saved a huge amount of money [to me] before going to college, some of which was from selling my dream car, a twin turbo z. I know a decent amount about buying/selling used cars, so I do 2 a month or so to help me make ends meet. This car cost me 4200, not exactly a bank crusher, and is worth about 6k. One of my better finds. I am 20 years old with a motorcycle, and usually 2 cars [like right now]. Full coverage under my own name is REDICULOUS. I have 1 ticket on my record, but even if I didn't it would be very high. I'm talking 6-8 a MONTH if I had full coverage on all my cars. I already pay nearly 200, just for liability. Sometimes it does take a couple months to sell a car, and I barely drive it during those times. That's why I don't have full coverage, and if I did, I'd be an idiot. The term highend correlates but not absolutely with a car's value, moreso to its market. This LS400 is highend based on its market, not its price/worth. People buy integras, accords, avalons, and even z's with dents. People don't buy LS400's with body damage of nearly any kind, because of the market. It's like a ferrari owner selling a car with a mirror broken off or something [just an analogy, don't throw cement blocks at me].

You don't have to have a dealer license no matter how many you sell. However, you do have to pay 'consumer' taxes on the vehicles if you don't. That is pretty much the purpose of a dealer license. I don't know enough details on it, though I've been looking into it.

In colorado a dealers license is a big steaming pile of BS. You have to have an office where you are open so many hours a week(so that you are actually like a real business with a store front and such). The real kicker is that if you sell more than 5 cars a year you have to legally get a dealers license.....which is also a load of BS....
I say again its just a regulartoy thing to keep smaller car dealers down.
This is me parking my worst:
It was snowy at the time, since no one could see the parking lines we all just parked like you would in a dirt parking lot, leaving the room that you feel comfortable with, well after 4 or 5 days the snow mostly clears and you can see the parking lines, so I parked nicely, didnt think that my spot would change, and came back out to that....I laughed my ass off so much, I felt like such a douche because of how poorly i was parked, I had to climb in the pass side to get it...
