Need some advice regarding tickets in NY. I got a 69 in a 40 yesterday from a local cop while driving near Bear Mountain. I've got a clean record, and I'd like it to stay that way. Does anybody have any suggestions for the best way to handle this? Do I need a lawyer?

When I lived in Newburgh, I got nailed by a state trooper in my MR2. I explained I had no problem paying the fine, but my insurance people were a-holes and would drop me. When it came to my court date, the cop spoke to the judge. I got ticketed for broken windshield wipers, paid my fine, and was on my way. Funny postscript to that, as I'm paying the clerk, the person behind me pleads guilty to the exact same thing!

They just want the money. You need a lawyer and ticket for improper equipment. It is easier for the lawyer to ask for that than you.
If your speedometer reads slow, not fast, that can make it easier.
Point out the rear tires are larger than front etc. You are not dealing with auto enthusiasts.
This should work in any State.

Yesterday, a buddy of mine (he was on his ZX10-R, err, that's a Kawasaki) was trying to catch up with the rest of our group. He got stuck in traffic behind us. Turns out he's 30 minutes late for lunch at the Cripple Creek casinos.

His excuse: he passed an unmarked Ford Exlporer. He was doing 90. The cop chased him for three miles. Cop called out a roadblock. My buddy stops. Cop says, "Hey, didn't you see me?" followed by, "I've had my lights and siren on for over three miles!?!". My buddy's response, "Uhh, I was doing 90 so I was more concerned about what was in front of me than behind."

End result: 6 points for doing 90 in a 60, 8 points for reckless driving, 2 points for no proof of insurance, 4 points for no signal in a lane change. GRAND TOTAL= 20 POINTS IN VIOLATIONS . The cops let him go on his promise to appear in court.

So he's chewing down his lunch and asking what he should do about it? I tell him to get off his dead ass and go around the casino asking the employees who is a good LOCAL ATTORNEY. He does. He comes back 15 minutes later with the names of several lawyers to call.

Bottom line, get someone who plays golf with the judge and prosecutor. Do it fast before the rest of your "speeding buddies" (the unlucky ones who got the same court dates) hire the best guy and he's too busy to help you.

On a side note: Another buddy of mine went to a small town court with a big city traffic lawyer. The judge ended up uping the ticket from 4 points to 6 and a fine from 100 bucks to 300 . Moral: If you gonna play "courthouse", do it by their rules.

I'm not sure if you're able to use this in NY, but my buddy got 4 out of 5 tickets erased using this.

I got a $175 speeding ticket a year ago in NJ. I went online that night and found out there's a whole cadre of local lawyers who advertise on the web that they can help with speeding tickets. I spoke with 2 lawyers the next day, who were actually very helpful and up-front and told me that it would end up costing me about $800 additional to fight the ticket including lawyers' fees and extra $$ to get the charge reduced. One even looked up the schedule and verified that the cop was gonna be on duty and thus in court on the date my case would be heard so it probably wouldn't be dropped even if he represented me or if I showed up. Bottom line: both lawyers discouraged me from fighting. In addition I spoke to the motor vehicle dept in my home state (CT) and they said an out-of-state speeding ticket would not result in points on my CT driver's license. So I'd suggest contacting a traffic lawyer wherever the ticket was issued.

AFAIK, they can't ticket him for speeding AND reckless driving for the same offense. Unless he was ALSO swerving through traffic, double jeopardy applies, and the reckless driving charge should be dropped. He should get a lawyer.

Just as a side note...reckless operation is a bad, bad thing insurance wise.

Always get that one reduced...
