A&Q about 350Z
Q:
Well guys today my settlement check arrived from Nissan North America. I just wanted to say one last thank you to everyone who posted on this forum in the past year-and-a-half. I feel that if it was not for this forum and others I would not have pursued a lawsuit against Nissan. I found a lot of valuable information from this site.
I'll stop by from time to time to help warn those interested in buying this car of the potential dangers they face. And also to help out those who do not know what to do.
Thanks again!
A:
Good for U!
Make sure that you never buy another Nissan despite the settlement as you shouldn't have had to file a suit in the first place. Nissan should fix the damn problems!
A:
You buy a high performance sports car, and expect to get long life out of low treadwear high performance tires??
I bet if you spilled coffee on yourself, you would sue for the coffee being too hot.
People like you are a growing problem in the US.

Good for you mxpx and ditto to your intent to warn others of potential problems they face with this POS and hlep those already in the tentacles of this white octopus.
A:
Wow. That's all I ever hear on this site. I'm not saying that it's not good that you didn't get your money back, I'm not saying that Nissan has done the right thing with people who have had lemons, but your message of hate nissan pos............ it's getting repetitive and almost annoying enough for me to just quit coming to this forum.
Every other post is feathering, cupping, finally my money back, blah...
A:
I'm not gonna say that you getting your money back wasn't a good thing... because it is I suppose... obviously you weren't happy with the car ans the feathering issue was a really good scapegoat... as for the people that have the same issue and still love the car, me for instance, i think the car is fine, cupping or feathering, whatever you choose to call it is acceptable to me because of the great performance... everything has it's cost and performance is no exception... I've even had one of my front tires get eaten away so bad in the front that a strand of the rubber got wrapped around my suspension and basically unravelled the tire and blew it out... going 65 on the freeway... of course i was pissed but i got over it...
I have yet to join a lawsuit...
Granted i don't like Nissan but i'll just stick to my Independant shops and such... :-)

My Z is awesome. I love it. Previous owner got the feathering problem fixed, and I haven't had any complaints.
I am angry at Nissan about my back tires, however. They have worn out really fast, due to Nissan's negligent failure to design the car in such a way that I could not drive aggressively and burn rubber. If Nissan had designed the Z correctly, it would not tempt me to peel out of stoplights and screech around corners, and then I wouldn't have to replace those damn rear tires!

Congrats, so how did the final details work out? did they have you leave the car at the dealer and then send you a check? was the settlement the price you paid for the car? how long were you out of a car before the setttlement check arrived?
A:
Yeah...give us some inspiring details.
My SB ZR still feels like HEAVEN....what a wild ride!

No i beg your pardon, i am not oblivious to the problem, truthfully i couldn't get a nissan dealership to take a dump on my hood unless i had hard precise proof that there was something wrong...
the clicking of the driveshaft, grease streaks, skipping of the Bose CD player, trunk not opening on first release (which still doesn't work like designed).
The only thing i am surprised the agreed to fix because it wasn't able to flaw when they tried it was the skipping of the cd player... because it had to be cold in order for it to do it...
anyways, i had to wait for 3 WEEKS just to get a Lug nut stud because THEY stripped it out... when i did my walk around to find all the problems with the car before i bought it, i found that it 1) needed a stud 2) needed a new coin tray (physically broken) 3) needed the front bumper repainted (looked like someone drove cross contry behind a rock truck) 4) needed new tires 5) Couldn't accelerate past 35-40 MPH 6) missing a tire pressure sensor monitor...then later found out that 7) the tires were backwards 8) they were all different tire treads... should i go on?

Actually, the "lawsuit problem" is a total myth. Most of the suits that make the rounds on the internet never happened. Lawsuits only account for a tiny percentage of the costs of medical care.
The coffee cup suit is real, but there was more to it than you heard. First, she wasn't driving the car, merely trying to put sugar in the coffee at the time. Second, the real story was a 190f cup of coffee, and it removed the skin completely from her body where it scalded her and put her in the hospital for weeks, totally horrific injury. Around 6% of her entire skin was lost due to the burn, and required serious skin grafting. She asked McDonalds to pay only $20,000 and settle out of court, just what her medical bills were, but McDonalds refused to help.
The McDonalds that served it had been warned that they were making the coffee far too hot, and they had burned 700 other people before.
The amount awarded to the woman was intended to be punitive and harm McDonalds for the harm they caused the 700 other people because they refused to admit that they were burning people, even though their own quality guy said it would happen.
The real problem with "frivolous lawsuits" is that most people don't know the real facts or what really happened. Courts aren't stupid.
A:
And juries can be very stupid. To think all courts and juries are intelligent is just naive.
Frivolous lawsuits prevail, so don't dismiss people by simply saying they don't know the facts.

Care to back this up?
They haven't shown that they do know the facts. There is a difference between filing a frivolous lawsuit and winning one. Here is a great article you might want to read. It's sad how many people don't understand the legal system in this country, and yet push for things like tort reform and patent reform, when they have no clue what the real story is.
Some quotes:
"President Bush is now pushing for "tort reform," claiming that lawsuits are hurting the economy. Contrary to popular belief, since 1975 the number of lawsuits has declined. Government data show that the median jury verdict for punitive damages was only $37,000, significantly less than the $65,000 median award in 1992.'"
"It wasn't until the 1950's that lawyers began to make progress in getting judicial precedents that established corporate responsibility for injuries to workers and consumers. Corporations started to be held accountable and consequently their insurance companies were increasingly being forced to pay damages. The insurance industry responded with a public relations campaign against "excessive awards." Their strategy was to convince people who might sit on juries that there was a problem. "

Feathering is still a problem with the car despite what Nissan people will tell you. Since they did change the suspension for the 06 model I would say this should be taken care of. This still means that Nissan should still fix 03-05 models for free. Not going to happen unless a "frivolous" lawsuit makes them do it.
Since I leased mine they get it back whether they fix it or not and I'll never buy Nissan/Infiniti again.

My Friday posts on several threads were deleted by the mods, so I'll withdraw form this debate now. Maybe you can get norm to start it up again on Car Talk. He seems to get away with stuff like that.
