There was a discussion about this on some other board a while back, you can take it into a CARB testing facility and have it tested and certified, but it will cost more than its worth. When you go in to get inspection just put your stock one back on.

Also, for most popular engines, there is a variety of CARB-legal intakes that one can pick up a legal one and save the hassle.
The old, illegal intake can be sold on e-bay, where it may be legal in other states.
