I had my Mk2 smashed into by an uninsured wan**r:
The bloke just drove off but we tracked him down by his smashed refelector he left behind by phoning local Mitsubishi dealers and checking against the partial reg no we got him.
It is a company vehicle being used by the office junior which is not insured for social use.
He and the company have admitted full liability.
I have sent an estimate to him, which being a tornado pink golf needing a new rear quarter will need a complete respray: £4500!!!
I have also said the car owes me £2000 and i would accept that if i could keep the car and take off the steelies etc.
If this gets difficult and the bloke turns into an **** about it does anyone know where i stand legally?
Can i sue the company as they have admitted liability. Apart from anything else i havent got a car at the moment!

Excellent progress made. Thought you were out of luck on that one. Bide your time, and be prepared to pass all details over to your insurance company if they wont settle the claim.

You need them to sign a statement confirming that they are responsible. Tell them that you have witnesses of the accident.
Then take it to your insurance and see what they say. If no joy there then contact your lawyer or your local citizens advice, they might be able to help you.
If your insurance company think there will be a good outcome they may be able to get you a courtesy car, so tell them that you need a car for work etc.

That can invalidate his insurance - look at the small print. Even if it is clearly your fault, admitting fault is not allowed. Leave the "whodunnit?" to the insurance company.

I'm no legal expert, but I believe the law was broken when the offending driver "left the scene of an accident".....
